Obituary in the Van Wert Times, Friday, October 11, 1881
Death of Robert Kear.
Sunday evening, Nov. 6th, Mr. Robert Kear died of Bright's disease,after a long and tedious illness, aged 33 years. He was born in this townand had always lived here. He leaves a wife and five children.
Mr. Kear was not a member of any church, but while on his death-bed,made a profession of conversion. He was for a number of years and up tohis death an efficient member of the fire company and having been one ofthe first persons born in this county, was well known. His funeral washeld at the Methodist Church, Tuesday afternoon at two, Rev. Fishofficiating. The burial took place at the old cemetery.

An interesting anecdote involving Levi and indicating some of histemperament, appeared in an Allen County, Ohio, history. A transcriptfrom the docket of John Amstutz, Justice of the Peace of RichlandTownship, Allen County in the case of the State of Ohio against Levi Topeis summarized here:
"This day appeared before me John Amstutz, a Justice of the Peace ofsaid county, Isaac N. Mark, and made oath by an affidavit that Levi Topeassaulted and struck him in a menacing manner. Therefore the said IsaacN. Mark was the complainant and said Levi Tope the defendant. A Statewarrant was therefore issued forthwith against said Levi Tope, defendant,and the same was delivered by the said Isaac N. Mark, to William Lewis,Constable of Richland Township. . . . There was also a subpoena issuedfor State witnesses against [a list of nine men followed] who werecommanded to appear forthwith July 1, 1857. . . The said Levi Topeappeared before me at half past 9 o'clock . . . and asked for a subpoenafor [a list of nine men followed] . . . to appear to defend him . . ."[Levi also asked for another Justice to assist John Amstutz, and GeorgeW. Goble was called].
The trial began at 3 o'clock the same day and "I [i.e., JohnAmstutz] will have said Goble as my assistant, in every respect, duringthe trial, stating the reason such that thins appear to be ticklish anddubious and critical . . ."
The trial began by Levi pleading "not guilty." I. N. Mark was thefirst to testify followed by three of the witnesses for him. Then threeof Levi's witnesses testified.
Justices Amstutz and Goble retired to another room, and afterdiscussing the testimony concluded that both men were equally at fault,that the complainant provoked the assault. Their judgment was todischarge the defendant and each of them would pay their own costs. Thecomplainant wanted the defendant to confess he had done wrong, but Levirefused. Justice Amstutz offered to withdraw the fees, but Levi stillrefused. The transcript continues, "Therefore, in the name of us both, Idischarge the defendant and complainant shall pay the costs of theaction, and this was our final judgment, and all what we could doaccording to the law in that case. But I, for my part will never considerit a pure judgment according to the whole transactions and circumstancesbetween the complainant and defendant, as both parties trespassed thecivil action of reasonable men, and the ought to pay for it alike aslessons."
"This transcript was given to the complainant on his request. Hisintention is to reverse the judgment of this action, but the transcriptitself will show that I was trying to act in a way that might producemore than this course." There is no account of an appeal, and the articleconcluded with the historian's statement, "The manner in which JusticeAmstutz's good offices were received no doubt taught him that justice andphilanthropy are not entirely synonymous."
